Contract & Liability Waiver

To Whom It May Concern:

_____________________ (hereafter referred to as "Client") has purchased original artwork and/or high-resolution digital files from his/her photography session with Furbaby PhotographyTM (hereafter referred to as "Company").

 

Client is hereby granted permission by Company to reproduce the images and make an unlimited number of prints, for personal use only. Client agrees that he/she may not use any of Company’s images for commercial or editorial purposes or enter any of Company’s images into competition without the express written permission of Company. Company retains the copyright to all images.

 

Copyright and Licensing Notice

The images being provided to you are licensed to you for any reasonable personal purposes, including but not limited to: printing, copying, emailing, and web publishing. Your license does not include any use that results in financial gain, such as advertising, stock photography, print sale profits, or resale of any nature. Your purchase of the original files releases Company from any liability due to loss or damage of images, and also releases Company from any obligation to maintain copies of any digital image or photograph. Company may revoke this license at any time for any reason. Company retains all copyrights to the images and derivative works thereof. By using any of these images, you agree to the above terms.

 

Cancellation Policy

Session payments must be made 48 hours prior to the scheduled session. If payment is not received, the session will be canceled, with the opportunity to reschedule once payment is made in full.

Payment Policy

• All session payments must be made 48 hours prior to the session.

• Artwork payments must be paid in full before receiving final artwork.

• Company is not responsible for lost or damaged files after the files have been purchased and transferred electronically.

Model Release

The Client grants the Photographer permission to use the Client’s image or likeness in any and all forms of media for commercial purposes, advertising, trade, personal use, or any and all other uses. The Photographer may sell photos containing the Client’s likeness to third parties.

Indemnification

1. The Client agrees to indemnify and hold harmless the Photographer for any liability, damage, or loss related to technological failure, including data loss.

2. The Client agrees to hold the Photographer harmless for any personal injury or injury to their pets that may occur while the Client poses or works with the Photographer.
